    Premier steps in to calm Central Taiwan Science Park controversy (2010/08/11)

    Premier Wu Den-yih is trying to calm the flames of controversy over a court order to stop expansion of the Central Taiwan Science Park. Wu backs a government decision to allow companies to continue to operate in the park, saying third parties shouldn’t be affected by the ruling. But a lawyer defending farmers’ interest in the case calls Wu’s reasoning nonsense.

    The National Science Council announced Tuesday that it will stop infrastructure work at the Central Taiwan Science Park but that manufactures already inside the park can continue production. On Wednesday, Premier Wu Den-yih felt compelled to come forward to calm any controversy.

    The Council of Grand Justices Meeting No. 589 explained the trust protection principle. In this verdict, the parties being sued were the EPA, NSC and the Central Taiwan Science Park management. Third parties (such as companies already in the park) should not be affected.

    It’s a classic example of muddying the waters. They insist on saying this because the general public will never see this type of verdict. So they can get away with saying this nonsense.

    Chan went on to say that Wu’s idea that the companies already in the park can continue to work is equal to snubbing the High Court’s injunction and could cause a constitutional crisis.

    If the trust protection principle were to be shaken then that would be a constitutional crisis. The Central Taiwan Science Park administration does not want to expand the effective range of the judges’ verdict to include third parties who have acted in good faith. The administration is concerned that requiring production to stop would cause the verdict to be unjust.

    The premier, science park administration and EPA are all twisting the meaning of this verdict and ruling. It’s not others who are expanding the meaning.

    The Central Taiwan Science Park controversy has moved from being a problem with environmental impact assessments to an examination of the government’s credibility. If government officials are unable to deal with the matter appropriately, the controversy is likely to continue.

    中科爭議,行政法院判決要停止開發行為,中科局昨天卻宣布"停工不停產",也就是說廠商可以繼續營運。外界批評這項做法是在藐視司法,恐怕引發憲政危機,不過吳揆力挺中科局,還搬出大法官解釋,強調基於信賴保護原則,廠商是善意第三者,不該受到牽連

    中科停工的火持續延燒,逼得行政院長吳敦義得再度親上火線,因為8月10號,中科局宣布園區"停工但不停產",又掀起爭議。

    “完全就是典型混淆視聽的烏賊戰術,他們就是仗勢著說一般民間也接觸不到這樣的裁定書,所以就這樣信口胡言亂語”

    法界批評,吳敦義力挺中科局"停工不停產的決定",等於是藐視最高行政法院,恐怕會引發憲政危機。

    “信賴保護原則被動搖了那才是憲政的危機,他們(中科局)不希望說擴大解釋法官裁定的有效範圍,去波及到善意的第三人,中科局擔心這樣做(要廠商停產),反而會陷裁定(停工)的法官於不義”

    “閣揆到國科會(中科局)到環保署,是他們自己在扭曲判決,自己在扭曲法律的規定,而不是別人在擴大解釋”

    中科爭議,從環保議題再燒出政府誠信問題,官員再不妥善處理,火只怕會繼續燒下去。
